Will Foreclosures Stop or will Obama and Republicans Demand Foreclosures Increase? Pay Mortgage Now Before Faster Foreclosure Changes

dow2664

The stock market is surging since the mid-term election results came in and since the Fed’s gave their policy statement this week on stimulating the economy by eating up a bunch of treasuries. Republicans have gained control of the House and gained seats in the Senate. The Republicans are now, and always have been, thought of as business savvy. The Housing market continues to remain in the dumps and foreclosures have added up. The people want to stop the foreclosure process and find ways to refinance and make their monthly mortgage payments. The foreclosure process has been stalled as of late due to legalities relating to the paperwork process, and banks are having to check twice to make sure that the process of foreclosure meets all regulations and legislative requirements. This process of checks and balances relating to the paperwork and foreclosure is at risk of changing again due to new leadership in government. Plus, contrary to the position that was taken on foreclosures just over a year ago, the Obama administration is now singing a different tune. The head of the Treasury Department’s Home Ownership Preservation Office, Phyllis Caldwell, stated that “an important part of ensuring long term stability in the market is to enable properties to be resold to families who can afford to purchased them.” In essence, this statement is promotion of the need to get the foreclosure machine running again to rebuild the housing market. Brief Pullback Could Create Buying Opportunity

Editor’s Note: Filing in for Sam Collins is Ryan Mallory, founder of the financial blog SharePlanner.com . Sam will return Monday, Nov. 8. Current Long Positions (stop-losses in parentheses): TICC ($9.97), NFLX ($165), MCD ($76.92), QID ($11.92) Current Short Positions (stop-losses in parentheses): None Bias: 6% Long (-10% short considering the leverage in QID) Economic Reports Due Out (Times are EST): employment situation (8:30 a.m.), pending home sales index (12:30 p.m.), Bernanke speaks (2 p.m.), consumer credit (3 p.m.) My Observations and What to Expect * Futures are showing some weakness prior to the employment number. * Asian markets are seeing a lot of strength in trading with gains as much as 2.8%. European markets are trading with a slight negative bias to them. * The S&P is clearly in a breakout mode after recently trading out of consolidation from the previous three weeks. * S&P managed to close well above the 200-week moving average, which has acted as major resistance to the overall market — very bullish and promising for its long-term prospects.  * Yesterday’s rally pushed the market above the April highs, which allows for the market to continue the long-term trend, dating back to March 2009. * The employment number should play a pivotal role in the today’s market action.   * Be very careful about piling on new positions at this stage of the rally. The market is overextended and well outside of its Bollinger bands , and makes it more likely we’ll see a healthy pullback or at the very least some consolidation before moving higher. Use any weakness to add new positions to the portfolio. * The bears’ main aim is to erase at least 50%-60% of yesterdays gains, which would essentially create a bearish piercing candle pattern. Actions I Will Be Taking * Took solid profits in Amazon.com, Inc. (NASDAQ: AMZN ), SanDisk Corporation (NASDAQ: SNDK ), Jack in the Box Inc. (NASDAQ: JACK ) and Greenhill & Co., Inc. (NYSE: GHL ) yesterday. * Added two new positions at the market close yesterday: McDonald’s Corporation (NYSE: MCD ) and ProShares UltraShort QQQ ETF (NYSE: QID ). QID is a short-term trade to take advantage of possible consolidation or a light market pullback. * Will not hesitate to take profits in QID if the market pulls back 0.7% to 1%. * I’ll be aggressive in adding new long positions to the portfolio on any market weakness. * Follow me in the SharePlanner Chat-Room today for all my live trades, including my day trades. Today’s Gold, Silver, Copper Price Per Ounce Futures look Bright; Federal Reserve Stimulates Economy and Commodities Notes November 7th, 2010

dow2664

Commodities are surging and investors look for gold to continue recent upward trends. Last weeks announcement from the Federal Reserve played a big part in the end of week market trending and the potential for further devaluation of the dollar. The Federal Reserve plans to buy $600 billion worth of government bonds in an effort to decrease interest rates, make loans cheaper and ultimately stimulate spending across the American economic landscape. As a result, Friday was a huge day for stock action and the index values closed the day out at 2-year highs. The expectation is that, due to the Federal Reserve's move to initiate further quantitative easing, interest rates will remain low for the long term and spending will increase. Federal Reserve Chairman is having to defend this plan however. Critics of the plan feel that the large amount of the greenback that is being injected into the economy could prompt inflation or bubble pricing of bonds and commodities. Apprehension are currently at a minimum though relative to this thought. Investors look towards the safe haven yellow metal asset as the Federal Reserve's move to support the economy through a process of quantitative easing is pushing commodity value trends into the upper tiers of the stock market. Towards the end of last week’s close, gold prices came off of a fresh record and the expectation is that excess liquidity will depreciate the dollar further which is normally an inverse relative to gold and commodity values. The gold, silver, copper and metal futures are shining bright currently, but a hint of apprehension is in the air for the bubble. Author: Camillo Zucari

Exclusive Interview with Ken Fisher Part 3 - Con Artists, Madoff, Rats

dow2664

Ken Fisher is a money manager, and on the list of the Forbes 400 Richest Americans. He is also a Forbes columnist, where he recently recmmended several income stocks, such as TransCanada (TRP), Repsol (REP), and Sanofi-Aventis (SNY). His latest book, Debunkery: Learn It, Do It, and Profit from It-Seeing Through Wall Street’s Money-Killing Myths was just published. He is also author of several other books, including The Ten Roads to Riches: The Ways the Wealthy Got There (And How You Can Too!) and How to Smell a Rat: The Five Signs of Financial Fraud Ken Fisher Interview Part 3 Please note: Interview took place on Wednesday, October 27, 2010 Stockerblog: Let’s talk about Bunk number 11, A Good Con Artist is Hard to Spot. As a follow-up to your How to Smell a Rat book from last year, do you think things have change in terms of the government taking a look at possible rats, or individual investors being more alert and aware, or do you think nothing has really changed? Fisher: I think there’s been a little bit of change on the part of the government but only a little bit, and let me address that. First, while my book How to Smell a Rat made the best sellers list, for the most part in today’s world, book sales are down anyway. You can make the New York Times best sellers list if your book sells 35,000 copies in the first year, which isn’t that much. My Only Three Questions book had to sell 125,000 copies in 2007 to do that. Today you can do it for about 35,000 copies. So that tells you 35,000 people bought the book, probably half of them never even opened it, and gave it to somebody as a gift or whatever, and people got it as a gift, and so on. So my point is not that many people as a percent of the investor world actually gets past the basic methodology. There’s this notion that nobody could have figured out Bernard Madoff was Bernard Madoff. Bernard Madoff, as I wrote about it in the book, had ALL the classic signs of the con artist, every single one, straight on down the list, and the most telling about that was that he took custody. Now what the SEC is starting to do, which is very good in the aftermath of Madoff and as I prescribed in that book, not that they listen to me, they understand this, the SEC has accelerated their inspections of those who take custody and put more emphasis on them and less emphasis on those that don’t take custody, because they understand that this kind of thing happens 100% of the time where somebody’s taking custody. So if you are looking for Bernard Madoff’s, you look among the realm of those that take custody. The dilemma unfortunately, is that you’ve got a lot of people that operate in realms that don’t require an SEC registration, and unless somebody complains about them, they’re not going to see them, smaller hedge funds and what have you. I think Bernard Madoffs will be harder to do at that size. If Madoff hadn’t existed, Stanford would have been the biggest one in history. Both of these were lots and lots of much smaller ones, and that world is still out there. That world, that I wrote about in How to Smell a Rat , every time you have a bear market, Ponzi scheme operators get uncovered. It’s kind of the Warren Buffett line that “you don’t know who’s swimming naked until the tide goes out.” Whenever you have a bear market and sentiment falls drastically, Ponzi scheme operators that are dependent on raising new money from optimistic people to pay off redemptions, which is the game of the Ponzi operator, they can’t do it so they get uncovered for the first time. And guys that have successfully Ponzi schemed through a whole market, they get uncovered in a bear market and the consequences of a bear market. So the big ones for this cycle have been done. But that doesn’t mean there aren’t people out that are still doing it. There will be and the next cycle around there will be another raid. Unfortunately, I don’t believe that this stuff ever goes away. It’s a little like the notion of mildew in a moist environment; you may clean it off here and clean it off there but once you wait, it just comes back. Or maybe Neil Young’s line in a song he did a long time ago that “rust never sleeps.” End of Part 3 The Debunkery book is available at Amazon . Ken Fisher obviously doesn’t give individual stock recommendations in his interviews, but some stocks he likes that were mentioned in his recent Forbes columns, including high dividend stocks, are available in the form of a free Excel list at WallStreetNewsNetwork.com. Federal Unemployment Benefit Extension Needed; 3 Tiers 99 weeks Needs Revised; Deadline Near to File Unemployment Papers; November 5th Notes

dow2664

Federal unemployment insurance is a hot topic right now due to two variables. One, the unemployment rate continues to remain at excessively high levels. Currently, the national unemployment rate in the United States is hovering around 9.6% which is about 5% higher than it was just over two years ago. Two, unemployment benefits are at risk of being discontinued for approximately two million people across America. If Congress does nothing in the next several weeks to extend unemployment benefits coverage, then approximately two million people will have to find another way to receive a reliable and predictable form of income. The deadline to file for federal unemployment benefits expires on November 30th and four days after that, over 800,000 people will stop receiving unemployment benefit checks according to the National Employment Law Project group. Republicans have recently gained more power in the House. They talk of fiscal responsibility and reducing the national budget deficit. Republicans have also blocked attempts at unemployment extensions several times this past year due to the above listed reasons. Federal jobless payments last 73 weeks and this kicks in after the initial state funded 26 weeks of jobless benefits comes to an end. Once an unemployed citizen moves through the tiers of time to receive unemployment, there are few options. President Obama is once again urging lawmakers to pass an extension to extend the deadline for federal benefits. Congress is running out of time though. There are less than a handful of days this month that Congress will be in session to consider the extension. Passing the extension just got harder too with the Republicans gaining the House and adding seats in the Senate. Author: Stephen Johnson

The drug wars in Mexico make great headlines, such as the news that drug cartel leader Ezequiel “Tony Tormenta” Cardenas was killed by the Mexican marines at the US/Mexico border yesterday. But what isn’t being mentioned is that first, the drug violence is confined to only certain areas, and second, the Mexican economy is improving, with the peso rising to the highest level since April, and 850,000 new jobs have been created so far this year. One of the wealthiest people in the world is from Mexico, billionaire Carlos Slim, the chairman and CEO of Telefonos de Mexico (TMX) and América Móvil (AMX). Mexico has one of the fastest growing economies in the world, with a 7.6% GDP growth rate. The middle class has been growing, per capital income has been rising, and inflation has been dropping over the last several years. Mexico had a positive trade surplus of $55 billion last year, and interestingly, has become the 9th largest holder of US debt. Based on gross domestic product in purchasing power parity, Mexico is the 11th largest economy in the world. Investors looking for opportunities south of the border can find ten Mexico stocks that pay dividends , all but one of which trades on the New York Stock Exchange, according to WallStreetNewsNetwork.com. As a matter of fact, one of the Carlos Slim stocks, Telefonos de Mexico, also known as Telmex, pays a healthy dividend of 4.8%. The stock trades at 11 times forward earnings. Another high yield Mexican stock is Grupo Aeroportuario Centro Norte (OMAB), which participates in the growth of the travel industry by operating airports in the central and northern regions of Mexico. The stock, which trades on NASDAQ, has a 3.7% yild, and a forward price to earnings ratio of 19. Fomento Economico Mexicano (FMX) is a beverage distributor of Coca Cola brands in Mexico along with several other Latin American countries including Guatemala, Nicaragua, Costa Rica, Panama, Colombia, Venezuela, Brazil, and Argentina. The stock sports a yield of 1.1% and sells for 16 times forward earnings. Is Netflix (NFLX) a Victim of Its Own Success?

Small-cap stocks have significantly outperformed the major blue chip indexes recently. But for long-term investors or folks in small-cap mutual funds or ETFs, there are a handful of top-performing companies that no longer deserve the label of "small cap" in your portfolio. That's because  these picks have seen runaway growth despite a crazy market in the last two or three years and now could be peaking — or at least, seeing growth slow significantly. I have discussed two of these companies so far this week, via ARM Holdings (NASDAQ: ARMH ) and AutoZone (NYSE: AZO ). Next up is Netflix (NASDAQ: NFLX ) — which had a market cap at the end of fiscal 2007 that totaled $1.7 billion and is now pushing $9.2 billion in market cap. Their businesses are quite different . . . ARM Holdings is a semiconductor stock and AutoZone is a car-parts retailer. But they each illustrate how rapid growth can only continue for so long.  Netflix (NASDAQ: NFLX ) is a typical high-tech success story: Come up with a great innovation for the digital age and ride that technology as far as it will go. Partnering DVD rentals with the postal service and the Internet was one of those ideas that seems so obvious in hindsight, but two California entrepreneurs laughed all the way to the bank by coming up with the idea first. The ascent of Netflix is common knowledge to investors, so we won't belabor the point here. Some highlights include doubling its revenue in the last four years, from just shy of $1 billion in fiscal 2006 to a projected $2.2 billion at the end of the current fiscal year and a nearly 500% surge in stock price since 2008. But with 16.9  million subscribers, the real question investors should ask is whether Netflix can keep growing — and if so, whether that growth is going to slow down. I don't have a crystal ball so I can't tell you what the future of home entertainment will be. Netflix succeeded in sending brick-and-mortar rental outfit Blockbuster into bankruptcy, but clearly it's going to need another trick beyond hard DVD sales. The company currently offers a limited catalog of streaming movies and TV shows on demand, and this appears to be the area of future growth. However, unlike the movie mailing game, Netflix is far from alone in that arena. Broadcast TV channels all offer their own programming via their own websites, and Apple Inc. (NASDAQ: AAPL ) and Google Inc . (NASDAQ: GOOG ) are both pushing to bring their own streaming video boxes into your home via Apple TV and Google TV . Then there's Hulu, movies on demand from cable companies like Comcast (NYSE: CMCSA ) and Time Warner (NYSE: TWX ),  and of course the threat of a new technology that we haven't heard about yet. Netflix is surely a great company that was smart enough to look beyond postal DVD rentals and to streaming video. But whether the company can dominate the digital arena is a big question. While Netflix added almost  2 million new subscribers during the third quarter, that kind of growth has to hit a wall eventually. Whether you think that wall will come in two quarters or two years, this much is clear:  Netflix has grown large enough and seen a big enough run-up in shares that it's unlikely to have many more big moves up its sleeve. Even if you are one of the investors who strongly disagrees that NFLX shares are overbought right now, you should seriously ask yourself if it's realistic for this stock to continue its small-cap growth curve. Without another game-changing technology, it's likely Netflix will see its red-hot sales growth cool off in the months ahead. Jeff Reeves is editor of InvestorPlace.com. Dollar Strengthens and Gold Price Per Ounce on the Rise; Gold For December Delivery High; Feds Stimulate Economy; Today’s Notes

dow2664

Surprisingly, gold continued its ascent even as the dollar strengthened yesterday. The Bureau of Labor Statistics reported this morning that the National Unemployment Rate remained at 9.6% for the third straight month. The Bureau of Labor also reported that the number of non-farm jobs rose by 151,000, but the number of people filing for unemployment remained unchanged at 14.8 million. The positive news here is that the economy did generate a net gain in jobs for the first time since May of 2010. The gain was stronger than many Wall Street analysts were expecting and the dollar gained on a basket of other currencies. Gold settled at a new record high yesterday. Gold for December delivery settled up $14.60 to $1,397.70 an ounce. Additionally and surprisingly, the dollar was up for the day as well. Normally there is an inverse relationship between gold and the dollar but that was not the case yesterday. Spot gold prices were rising too. In other commodity news, silver was in the green as well and posting at $26.75 an ounce. Platinum for January posted end of day numbers yesterday moving up to $1,768.90 an ounce. The rise is due, in part, to the Feds announcement this week that they would initiate another round of quantitative easing and buy up treasuries as part of their $600 billion asset purchase plans. A Busy Week!

Are rising Gold Prices just a fall in the Dollar…?

AS WE WRITE, late Friday afternoon here in South Africa on 5 Nov. 2010, the Gold Price is making an assault on the $1400 level having been $1332 on Wednesday, the day of the Fed announcement, writes Julian Phillips of the GoldForecaster.

In the days ahead of that announcement the Dollar had been wavering between $1.38 and $1.40 against the Euro. After the announcement the US Dollar fell quickly down to $1.42 per Euro. Against the Pound Sterling, the Yen, the Swiss Franc and most other currencies, the Dollar has weakened too. But then the Dollar recovered and is sitting at $1.41. Recently gold has again moved in the opposite direction to the Dollar, until it ran up in the Euro vigorously, but has this now changed again? Can there be more to the rise in gold than just the fall in the Dollar?

We believe so, because far more than QE2 happened this week.

In the run-up to and after the announcements of the results of the US mid-term elections the Gold Price barely moved. On the surface we can therefore conclude that the mid-term US elections did not affect the Gold Price. But whether the Republicans or the Democrats won is not an issue for the gold market. What is an issue for precious metals is whether the US government direct the monetary area sufficiently to invigorate the US economy and – should they wish to do so – strengthen the US Dollar?

On the contrary. We found the mid-term result pointed to an emasculation of the government’s power on the monetary front. Far too much of a burden has fallen on the shoulders of the Federal Reserve, an institution with only limited powers to resuscitate the US economy. Government should shoulder that role, supported in this by the Fed. Government does not appear to now have the capacity to resolve the economic problems of the US This tells us that the enormous steps needed to be taken to strengthen the US Dollar are not going to be taken, so a fall in the US Dollar is widely expected.

The difference for the Dollar now is that its fall can be precipitous and not simply a repeat of the fall in the last two years. Control over the Dollar’s value for the next two years appears to have slipped from the grasp of the US monetary authorities. This is extremely positive for the Gold Price.

Ahead of the Fed’s QE2 announcement, a ‘bear raid’ on gold was mounted that had the Gold Price drop from $1358 down to $1332 in a steep dive that shook the weak holders and triggered more than a few ‘stop loss’ positions. Ordinarily, this would have been enough to deter investors, but it happened when the market was seeing thin volumes of trade, hence the size of the fall. On the announcement, these bears received a very sharp, silver-coated golden horn in the sensitive parts. The Gold Price rose like a space shuttle, breaking up through the fifties and sixties and on through resistance at $1370. Right now we are tapping $1400 per ounce.

Undoubtedly the activity of buyers looking for physical Gold Bullion from most gold markets in the world was the primary driver. But add to this the scramble of short covering in New York’s derivative Comex Gold Futures market that is also going on. The short covering comes not only from those who went short ahead of the announcement, but from longer-term shorts, realizing that the break-out to new levels is well founded on fundamental factors. The announcement from the Fed re-established those fundamentals. However, a greater and greater proportion of Gold Investment buying globally is due to a growing fear of the global currency system itself.

What are the ramifications of the Fed’s announcement? The entire financial world had been waiting for weeks for the Fed to make this announcement. It was important because it directly affects the value of the Dollar inside and outside the US While the US does not intend to cause a devaluation that will enhance the international competitiveness of the US, that is what is happening. That is how the rest of the world will see it. They will take action in their own interests to protect themselves.

Foreign competitors have to act, or see themselves suffer as the US has been doing for some time now. This will have three primary effects on the global economy:

  • First, the United States will lose the cooperation they had hoped for from China and other nations whom they asked to let their currencies rise but who will now suffer from a lower Dollar. Global monetary cooperation, sorely needed now, will decay. Currency crises in different nations will be inevitable as they each strive to protect their own interests;
  • Foreign investment capital now channeled into the US (and badly needed) will accelerate its diversification from the Dollar. This will accelerate the fall of the Dollar and see capital exit the US. To the extent this happens it will act as a counter to QE2;
  • It will undermine the Dollar’s global hegemony, which in itself will create considerably more uncertainty as to exchange rates and values.
